AI Board's ninth meeting reviews enforcement priorities, cybersecurity plan
The AI Board met on 17 September under the Irish Presidency, its first session attended by Moldova as an observer. The Commission updated members on enforcement activity since the 2 August transparency deadline, on AI literacy recommendations, and on cooperation between market surveillance authorities ahead of the first wave of compliance inspections. For a practice built on Article 50 and Article 4 work, this is the clearest signal yet that the Commission is moving from guidance toward active supervision, and it sets a firm date: the tenth meeting sits alongside the Apply AI Summit on 17 November, itself preceded by AI Innovation Month opening in Dublin on 14 October.
Ninth Circuit affirms dismissal of DMCA claim against GitHub Copilot, OpenAI
The Ninth Circuit affirmed dismissal of the lead DMCA claim in Doe v. GitHub, the first copyright case brought against OpenAI's generative tools, in an opinion filed 16 September. The panel held that Copilot and Codex "create new works that never contained" the copyright management information plaintiffs point to, so AI output that resembles licensed code but omits attribution stays outside section 1202(b)'s reach. Breach of contract claims, and the underlying question of whether training on code requires the author's permission, both continue in the district court. For clients building or licensing into AI coding tools, copyright and contract terms remain the operative exposure; a DMCA attribution claim is a narrow route.
